Don Spike Admits To Buying And Using Drugs + Prosecution Requests 5 Years In Prison

Don Spike (real name Kim Min Soo) admitted the charges of using and buying methamphetamine but denied the charges of selling and arranging.

On December 20th, the 13th Division of the Criminal Agreement of the Seoul Northern District Court held the second trial of Don Spike, who was arrested and indicted on charges of violating the Act on Aggravated Punishment.

The prosecution requested Don Spike to be sentenced to 5 years in prison, confiscation of evidence, 200 hours of order to complete a rehabilitation treatment program, and an additional fine of 39,857,500 Won (approx. $31,000)

Prosecutors argued that although Don Spike’s confession of the crime worked in his favour, the amount of methamphetamine he handled was substantial, and he committed a drug crime that could affect society as a celebrity.

Don Spike, who attended the trial wearing a sky-blue shroud, left only the words, “I’m really sorry. I won’t do it again,” and went to the trial that lasted about 5 minutes with his head bowed. 

Don Spike is accused of buying 45 million (approx. $35,000) Won worth of methamphetamine on nine occasions from December of last year to September of last year and renting hotels and party rooms in the Gangnam area and injecting it 14 times.

Don Spike, who was arrested on September 26 at a hotel in Gangnam-gu, Seoul, was in possession of 30 grams of methamphetamine, which is about 1,000 doses. As a result, there was speculation that Don Spike was involved in sales and mediation.

However, Don Spike’s lawyer drew a line that day, saying, “The accused possessed and administered drugs at the time of arrest, but there was no fact that he sold or arranged them.” At the same time, Don Spike appealed for leniency, saying, “I am deeply reflecting on the crime, no matter what the circumstances.”

The lawyer mentioned the deterioration in the health of Don Spike, who has been imprisoned in the Eastern Detention Center since last September, and the livelihood difficulties of his family and restaurant employees due to his detention. The lawyer added, “The defendant’s fingertips were paralyzed, so he couldn’t even write well.”

Meanwhile, Don Spike was fined 5 million (approx. $4000) won in 2010 for smoking cannabis. In the same year, he was sentenced to one year in prison and two years probation for a separate drug-related charge.

Don Spike’s sentencing date will be held at 10 am KST on January 9 next year.
