Korean-American singer Yoo Seung Joon has a high possibility of returning to Korea after winning his final lawsuit against the government, in which he demanded the issuance of a Korean entry visa.
According to the legal community on the 30th of November, the Third Division of the Supreme Court (presided by Judge Heung-boo Lee) rejected the appeal in the lawsuit where Yoo Seung Joon sued the Los Angeles Consulate General for canceling his passport and visa issuance refusal.
The rejection of the appeal means that when a case is deemed not to be the subject of an appeal, it is not further reviewed and the appeal is dismissed. When the decision for non-prosecution is made, only a brief decision stating the reason for dismissal is delivered to the parties without a verdict.
Previously, in 2015, when Yoo Seung Joon was 39 years old, he filed his first lawsuit demanding the cancellation of the refusal of an overseas Korean visa issuance by the LA Consulate General. After the Appeal Trial and the Retrial, he finally won the lawsuit in the Supreme Court.
However, the LA Consulate General again refused to issue a visa, stating that Yoo Seung Joon’s evasion of military service could harm national interests. In October 2020, Yoo Seung Joon filed a second lawsuit against the LA Consulate General.
Although he lost in the first trial of the second lawsuit, he won in the second trial. The LA Consulate General then appealed, and on this day, the Supreme Court ruled that the case is not the subject of an appeal, dismissing it for non-prosecution.
If the government issues a visa according to the court’s decision, Yoo Seung Joon will be able to set foot on Korean soil for the first time in over 20 years since he was restricted from entering the country by the Ministry of Justice in 2002.
Yoo Seung Joon is an infamous kpop idol who had caused anger among many citizens with his past actions, as he released numerous hit songs and was loved for his diligent and youthful image in various entertainment programs. He promised to return to Korea after performing overseas and saying goodbye to his family, but he suddenly obtained US citizenship and was engulfed in allegations of dodging military service.
At that time, Yoo Seung Joon expressed his confusion and stated that he had no intention of giving up his US citizenship. He said he would return after serving his country, but he was issued a permanent entry ban by the Military Manpower Administration and was no longer allowed to set foot on Korean soil.
